Searching the Summers County Court Docket
Where you start depends on the court level. For Circuit Court cases filed from July 1, 1999 forward, use WVPASS. Registration and searches cost nothing there. Opening or downloading a document, though, runs 25 cents per page plus card processing. For magistrate matters, the Magistrate Case Record Search offers free basic case information by first name, last name, or case number. It does not supply documents. Copies come from the Summers County Magistrate Court Clerk.
Before searching any Summers County court docket, gather the party name, the possible court, the county, and any case or citation number. A precise number spares you same-name confusion. It also matters because the payment portal, MCRSearch, WVPASS, and CourtPLUS each use identifiers for different jobs. One warning from the official FAQ is worth heeding: confirm the case shell before buying a WVPASS document, because a wrong-case purchase is not refundable.
- Identify Circuit, Family, Magistrate, Hinton City, or federal court from the notice or filing.
- Use WVPASS for covered circuit records or MCRSearch for basic magistrate information.
- Match the county, court, case number, party roles, filing date, and case type.
- Read the latest docket entry and hearing notice, then confirm any uncertain setting with the proper clerk.
- Request a certified copy from the custodian when an official record is required.
Summers County Docket Portals
No single search box reaches every Summers County case. WVPASS is the paid-document route for public circuit files within its date range. MCRSearch is a free information service for magistrate matters. It can return up to 30 records. Narrow the spelling and lean on a case number when you can. A result is only a lead. It does not prove that a similarly named person is your person. The Judiciary itself warns that magistrate data may not be complete or accurate.
| Official service | Best use | Main limit |
|---|---|---|
| WVPASS | Public Circuit Court case details and documents | Covered cases begin July 1, 1999; documents cost per page |
| MCRSearch | Basic statewide magistrate case information | No online documents; results are capped at 30 |
| Magistrate Payment System | Exact citation, case, or payment-plan ID | Not a name-based docket search |
| CourtPLUS/E-File | Registered filing and service activity | Not the ordinary public search |
Neither state service serves as a Hinton City Court portal. A city ordinance citation should follow the local instructions printed on it.
Inside a Summers County Court Docket
Think of a docket as the ordered log of everything that happens in one case. It identifies the matter, and it records filed events: a complaint, motion, notice, hearing, order, judgment, or disposition. The case shell and the full case file are not the same thing. An entry may be public. An attachment may be absent, redacted, confidential, or available only from the clerk. A public online copy is never a certified copy.
| Case number | The court's unique identifier. Keep every dash and letter when searching. |
|---|---|
| Parties and roles | Names plus roles such as plaintiff, defendant, petitioner, or respondent. |
| Docket entries | Dated actions, filed papers, orders, notices, and status changes. |
| Hearing setting | Proceeding type, date, time, location, and judge when published. |
| Access flag | An indication that a document is public, unavailable, or restricted. |
| Disposition | The outcome recorded by the court, which may require a clerk copy for certified proof. |
Common docket terms carry narrow meanings. A setting is a scheduled court event. A continuance moves that event to a new time. A disposition records an outcome. A sealed item is withheld under a court order or rule; it is not simply a record that failed to appear online.
Summers County Docket Clerk Roles
Two separate elected offices hold the records people usually want. The Summers County Circuit Clerk keeps Circuit Court, Family Court, mental-hygiene, juvenile, and related appeal records. The office also manages docket records, juries, and court copies. The Magistrate Court Clerk handles lower-court criminal, civil, traffic, and special-proceeding files.
The Summers County Clerk, by contrast, holds deeds and trust deeds. It also keeps plats, vital records, wills, estates, and other county materials. Its online recorded-document index reaches back to 2005 and requires an account to print images. A judgment indexed with land records does not turn that index into a civil court docket. Send case-file requests to the court clerk. Send deed or recorded-instrument requests to the County Clerk.
Quick check: case motion or judgment means court clerk; deed, plat, will, or recorded instrument means County Clerk.
Courts That Keep Dockets in Summers County
Summers County sits in the 30th Judicial Circuit along with Monroe County. Its Family Court assignment spans Raleigh, Summers, and Wyoming Counties. Magistrate Court takes many lower-level matters. Hinton City Court enforces municipal ordinances. Federal cases arising in the county route through the Southern District of West Virginia's Beckley Division. Each level keeps its own docket and custodian.
| Court | Docket covers | Where to start |
|---|---|---|
| Circuit Court | Felonies, general civil cases, appeals, and general-jurisdiction matters | WVPASS or Circuit Clerk |
| Family Court | Divorce, custody, support, paternity, and domestic matters | Circuit Clerk, using the case county |
| Magistrate Court | Misdemeanors, traffic, preliminary felony work, and civil claims | MCRSearch or Magistrate Court Clerk |
| Hinton City Court | Hinton ordinance cases | Citation and Hinton City Hall |
| Federal District Court | Federal civil and criminal matters | PACER and the Beckley Division |
Summers County Docket Filings
Filing volume tells you how busy each court was. The 2025 West Virginia Judiciary Annual Report lists 176 circuit criminal filings and 95 circuit civil filings in Summers County, plus 515 magistrate criminal filings and 156 magistrate civil filings. These categories describe filings only, not unique people, pending inventory, convictions, or completed cases. Resist adding the court groups into a made-up county grand total.
That magistrate count includes 449 misdemeanor filings and 56 felony filings. A felony can begin with a magistrate proceeding and later carry a different Circuit Court number. So a name search may surface related entries in more than one court.
Find Summers County Court Dates
The county posts no official standalone court calendar. Start with the newest citation, notice, or order. Then check the matching official case service and call the clerk that holds the case. A requested continuance is not an approved reset. Treat the existing date as active until the court enters or communicates a change.
Phone numbers matter here. For Circuit Court, call 304-466-7103. The Magistrate Court Clerk is at 304-466-7129. A Hinton ordinance matter starts with City Hall at 304-466-3255. Family Court spans three counties. Give the case county, number, and division when you call. The full Summers County Court Dates process separates each channel.
When you reach someone, confirm the details one by one: the date, time, courtroom or appearance method, event type, judge, and current status. Save the office you contacted and the time of confirmation. If a date has passed, contact the clerk promptly. A missed event can produce a separate court response.
Hinton Cases on Summers County Dockets
Hinton holds the county seat. It stands as the only incorporated municipality in Summers County. Its City Code sets up a City Court to enforce the municipal code. Sessions happen when needed rather than on a fixed schedule. The code calls for docket entries and allows an appeal. Even so, the city publishes no current Hinton online docket, no standing session calendar, and no payment portal.
Check the citation heading before you search. A Hinton ordinance charge belongs to City Court at City Hall. A West Virginia traffic citation written inside Hinton usually travels the Magistrate Court route instead. When an appeal climbs to Circuit Court, the file lands with the Summers County Circuit Clerk. The same town can generate records in several courthouses. None of them share one database.
Recent city council minutes mention municipal-court proceedings and written orders. Local process is clearly alive. What the minutes do not create is a live public calendar. Property details in them should never be passed off as sample docket data for Summers County court records.
Public Access to Summers County Dockets
West Virginia law leans toward open inspection of court records, but access has real limits. Rules protecting privacy, sealed material, and special proceedings still apply. Some pages never make it online at all. Personal identifiers can require redaction. Juvenile proceedings are commonly restricted. Mental-hygiene and certain family matters call for extra care with any docket request.
Key rules:
WV Code §51-4-2 addresses inspection and copying of court records, subject to special rules.
Rule of Civil Procedure 5.2 governs privacy, redaction, and confidential filings.
WV Code §53-8-17 defines the process and balancing used for sealed court records.
WV Code §29B-1-3 requires reasonably specific public-record requests and sets response duties.
The West Virginia Freedom of Information Act covers public records generally. For judicial files, though, court-specific statutes and court rules still control. Ask the clerk for the right route rather than assuming a broad request can override a sealing order on a Summers County docket.
Missing Summers County Docket Results
A blank search result is not proof that no case exists. WVPASS coverage only reaches public circuit cases filed on or after July 1, 1999. Anything older may call for direct clerk research. A current matter might be sealed, juvenile, unscanned, mis-keyed, or sitting in another court entirely. MCRSearch imposes a result limit. It also warns about completeness. Hinton City Court and federal PACER are separate systems again.
- Restricted
- Access is limited by law, rule, or the nature of the proceeding.
- Redacted
- Sensitive details are removed while the rest of the filing may remain public.
- Sealed
- A court order or rule blocks ordinary public access.
- Uncertified
- A convenient copy that lacks the clerk's formal certification.
Start with the exact case number, an alternate spelling, and the right court. If a Summers County case still will not appear, give the clerk something tighter to work with. A narrow date range, the names, the record type, and any known identifier let staff tell a missing public file from a record outside their custody.
Docket Records at the Clerk's Office

Summers County Docket History
The Summers County courthouse bridges the paper era and statewide digital access. Court history records the details. The original two-story brick building was finished in 1877 on donated railroad land. Octagonal corner towers came in 1898. A 1926 rear addition doubled the structure, and one more addition followed in 1941. Visitors reach the second-floor courtroom by a spiral cast-iron stair inside a tower.
The digital side arrived in layers. CourtPLUS/E-File reached statewide circuit and family filing in 2024. WVPASS opened statewide public circuit access in March 2025. A Judiciary data dashboard followed in July 2026 with daily preliminary updates. The courthouse still matters. Clerks keep the authoritative files, scan material, fix access problems, and issue certified copies of any Summers County court docket.
CourtPLUS and Summers County Dockets
West Virginia Circuit and Family Courts E-File also goes by the name CourtPLUS. It serves registered attorneys, government users, and court staff. The filing history can be searched many ways. Use a full case number, reference code, county, filing type, status, or filing-date range. Results follow each submission through processing states. A submission might show judge review, rejected, payment, or unable to process.
A CourtPLUS reference code can pull up a filing receipt. It can also verify an electronic order. It is not a stand-in for a public case number, though. Members of the public should turn to WVPASS or the Summers County clerk. Magistrate Court researchers use MCRSearch and the Magistrate Court Clerk. Keep those roles straight. That keeps a filing receipt from being mistaken for the full court docket.
Process: Electronic filing → clerk processing → court docket entry → public access when allowed → clerk certification when requested.
Summers County Court Dockets by City
Hinton is the one incorporated municipality the county identifies. The county reports a 2020 population of 2,245. Unincorporated communities do not get invented municipal docket pages here. Hinton's local court takes city ordinance matters, while state criminal, civil, family, and traffic cases flow through the proper Summers County court and its criminal docket or civil docket.
